ROSENDALE - Town Planning Board members gave the green light
last week to one of their own with preliminary approval
for a major subdivision of the Hidden Valley Lake property.
The 213-acre parcel is located off Whiteport Road, includes
Third Binnewater Lake, and borders the New Jersey Bible
Conference property.
Jeanne Walsh, a Planning Board member and owner of the property,
did not participate in the discussion or voting Thursday.
Planning Board Chairman Jere Brown told the public the site
plan is known as Lakeview Properties and the owner has plans
only to divide the existing property.
"The owner is not planning to do major construction
at the site. The owner is basically dividing the existing
property and each existing structure on that property will
have its own separate lot," Brown said.
"One lot will be totally undeveloped," Brown added.
"At the last meeting we adjourned with questions regarding
easements, right of ways and sanitary wastewater."
Samsonville surveyor Terry Ringler responded to those questions
and referenced deeded rights-of-way going back to the 1800s
that were designated for wagon use and leading animals to
water.
One right of way still in question was once the property
of the New York State Thruway Authority, which turned it
over to the town in 1955. Ringler said he is still investigating
if this can be resolved.
"If the town can take on responsibility of this road
is to be determined," Ringler said. "There was
never any abandonment action done by the town. My interpretation
is this is a former town road and anyone who abuts it has
the right to use it. The question is, does the town have
an obligation to maintain it, is an issue of law. There
is no written document of that road in the deeds,"
said Ringler.
Regarding the wastewater issue, real estate broker Joseph
Deegan said all five septic stations have been pumped out
and all but the one at the main house on the property have
been declared in good working condition. The recommendation
is for the metal tank serving the main house be replaced
as soon as possible, however the drain field is in acceptable
condition.
Preliminary approval of the plan drawing was given subject
to information still needed on the drawing. This included
identification of all survey lines and designation that
one lot will not have a well or septic and not be approved
as a building lot.
In other action at the meeting approval was given to Larry
Arnold, owner of the site of a former gas station and taxi
business at state Route 32 and Kallop Road, for a special
use permit to operate a granite counter shop and showroom
on the property. Plans include a small retail space, dispensing
space, and storage space. A owner-occupied apartment will
be located on the second floor.
Conditions included in the approval are a redirection of
parking, stabilization of land on the Kallop Road end of
the property, and designated hours of operation for 7 a.m.
to 8 p.m. on Monday through Friday and 9 a.m. to 5 p.m.
on Saturday and Sunday.
